What is the CE Marking and what is it for

The CE marking is a mandatory attestation that allows a construction product to be legally placed on the market within the European Economic Area (EEA).
This symbol not only ensures compliance with applicable regulations, but also guarantees alignment between the product and its declared performance, now consolidated in the new Declaration of Performance and Conformity (DoPC) introduced by the new Construction Products Regulation (EU) 2024/3110, generally applicable from 8 January 2026.

Where must the CE Mark be affixed?

The CE marking must be affixed directly to the product in a visible, legible and indelible manner, serving as immediate evidence of compliance with the essential requirements defined by one or more EU legislations. The manufacturer is responsible for affixing the CE marking.
Where it is not possible to affix the CE marking directly on the product (due to its nature), it may be affixed to the packaging or the accompanying transport documents.

Construction Products Regulation - CPR

The manufacture, commercialization and distribution of construction products are subject to mandatory and continuously evolving legislative provisions.

The main legal framework governing the European construction sector is the new Regulation (EU) 2024/3110, which repeals Regulation (EU) No 305/2011. It introduces harmonized conditions for the marketing of construction products and defines the basic requirements for the declaration of performance in relation to essential characteristics and CE marking.
Its implementation is progressive, in coordination with harmonized technical specifications, delegated acts and implementing acts.

Key dates
> 7 January 2025: entry into force of Regulation (EU) 2024/3110

> 8 January 2026: general date of application (subject to exceptions linked to harmonized technical specifications)

> Progressive application: the obligation for each product applies from 12 months after the publication of the relevant Harmonised Technical Specification in the Official Journal of the European Union (OJEU). For many product families, the actual transition to the new regime will take place progressively, depending on the publication and entry into application of the new harmonised technical specifications and the relevant EU acts.

What does CPR require from manufacturers?

Construction materials and products may bear the CE marking and be placed on the EEA market only if compliant with Regulation (EU) 2024/3110 and the relevant harmonized technical specifications (regardless of their country of manufacture).
The CPR expands the essential requirements. Annex I defines 8 basic requirements (previously 7):

1) Mechanical resistance and stability – Structural integrity of works
2) Safety in case of fire – Fire protection
3) Hygiene, health and the environment – Protection from negative impacts on health
4) Safety and accessibility in use – Safety for workers and users
5) Protection against noise – Acoustic insulation and sound properties
6) Energy economy and heat retention – Energy efficiency and thermal performance
7) Emissions into the outdoor environment – Emission control
8) Sustainable use of natural resources – NEW: Circular economy and environmental sustainability

Note
These requirements establish the technical link between construction products and the works in which they are incorporated. Regulatory competence for construction works remains with Member States.

CPR 2024/3110: key innovations

1. Mandatory environmental sustainability
The regulation introduces binding requirements for Life Cycle Assessment (LCA):
  • Predefined essential environmental characteristics (Annex II)
  • Assessment based on EN 15804 (EN 50693 for energy-related products)
  • Mandatory calculation covering all lifecycle stages
  • Progressive declaration:
    > Phase 1: Climate indicators (CO₂, energy consumption)
    > Phase 2: Recyclability, toxicity, resource efficiency
    • 2. Assessment system 3+ for sustainability
    The CPR 2024/3110 also introduces a new assessment system specifically for environmental sustainability: System 3+, which is added to the existing AVCP systems (4, 3, 2+, 1, 1+) and which, under the new framework, will take the designation AVS 3+

    The 3+ system is added to the pre-existing evaluation and verification systems 1, 2, 3, and 4. See the unified table in the section dedicated to the CE Marking process.

    System 3+ is complementary to existing systems and specifically targets sustainability verification.
    3. Digital Product Passport (DPP)
    The Regulation introduces the Construction Digital Product Passport, intended to become the reference digital container for the product’s technical, documentary and environmental information:
  • Digital repository of product information across its lifecycle
  • Interoperable with the ESPR Digital Product Passport
  • Includes: DoPC, technical data, sustainability information
  • Mandatory 18 months after the relevant Delegated Act
    • 4. Strengthened CE Marking
    Fundamental principle: on the EU market, the CE marking is the only marking permitted to attest conformity.
  • Other markings attesting conformity to different assessment methods are prohibited
  • The CE marking indicates conformity with declared performance and product requirements
  • The DoPC (Declaration of Performance and Conformity) unifies them into a single document
  • Greater responsibility of the manufacturer for product conformity
    • 5. Mandatory Green Public Procurement (GPP)
    Important innovation for the public sector with Green Public Procurement (GPP):
  • Contracting authorities must apply mandatory minimum environmental sustainability requirements in public contracts
  • Requirements established through Delegated Acts of the Commission
  • Possibility to set more ambitious requirements than the minimum
  • Derogations possible only in duly justified cases (e.g. single supplier, inadequate offers, disproportionate costs)
    • 6. Simplifications for SMEs
    The Regulation introduces important facilitations for small and medium-sized enterprises:
  • Sharing of test results between operators
  • Cascading use of technical documentation
  • Mutual recognition of certificates
  • Simplifications for micro-enterprises, limited to procedural and documentary aspects; the VVCP system remains determined by the risk of the product

  • Simplified procedures for products manufactured to the customer’s specification in non-serial processes

  • Exemption from the DoPC when the product is installed in a single identified work
    • 7. Circular Economy and Used Products
    Focus on reuse and remanufacturing:
  • Possibility to develop harmonised technical specifications for used and remanufactured products
  • Potential obligation for manufacturers to repurchase surplus or unsold new products
  • Deposit-refund systems authorised for Member States
  • Availability of spare parts for 10 years (extendable)
  • Design oriented to repairability, disinstallation and recycling
    • 8. Strengthening of Market Surveillance
  • Greater powers for national market surveillance authorities
  • European complaints portal managed by the Commission
  • Recovery of inspection costs from non-compliant operators
  • Reporting obligation for Member States on surveillance activities

  • Strengthened coordination between national authorities

    FAQ on CPR 2024/3110

    Regulation (EU) 2024/3110, which represents the new legislation on construction products (CPR), entered into force on 7 January 2025 and is applicable from 8 January 2026. However, the actual obligation for each product applies from 12 months after the publication of the relevant harmonised technical specification in the OJEU.
    The main innovations introduced by the new regulation are:

    • Digital Product Passport: this innovative tool is introduced to ensure greater transparency and accessibility of information related to materials
    • More stringent environmental criteria: the regulation imposes higher standards in terms of environmental sustainability for products placed on the market
    • New requirements for certifications: updates and new obligations are introduced regarding EPD (Environmental Product Declaration) certifications and LCA (Life Cycle Assessment)

    These measures will have a direct impact on manufacturers, suppliers and contractors, requiring an adaptation of business processes to turn these new constraints into opportunities for competitiveness and sustainability.
    The old regulation is repealed, but products certified under CPR 305/2011 may continue to be marketed until the entry into application of the new harmonised standards for their product family. The two regulations will coexist for years.
    Products with existing CE Marking may continue to be placed on the market. The transition to the new technical specifications will take place gradually, product by product, according to a multiannual work plan.
    LCA becomes mandatory progressively with an initial focus on product families with high sustainability impact:

    From 8 January 2026: basic essential environmental characteristics (points a–d, Annex II)
    Only for products covered by new harmonised technical specifications developed under CPR 2024
    Gradual introduction of additional characteristics through Delegated Acts
    LCA (Life Cycle Assessment) acts as a fundamental technical tool to meet the requirements of Regulation (EU) 2024/3110, providing the scientific basis for measuring product sustainability.

    Specifically, LCA supports the regulation by quantifying the environmental impact (e.g. CO₂ emissions) over the entire product life cycle, from raw material extraction to disposal.
    These quantitative data are essential to feed the Digital Product Passport and enable objective comparison between different construction materials.
    The Digital Product Passport (DPP) is a sort of digital “identity card” of the material that contains:

    Declaration of Performance and Conformity
    Complete technical data
    Environmental and LCA information
    Data on repairability, recyclability, spare parts.

    It will become mandatory 18 months after the Delegated Act establishing the system.
    The new regulation recognises:

    Used products: already used, disinstalled and reintroduced on the market
    Remanufactured products: used products subject to significant transformation processes.

    Dedicated harmonised technical specifications may be developed for these products, promoting the circular economy.
